EduShyster: Your open letter to students and alumni of Calvin College, opposing the confirmation of fellow alumna Betsy DeVos as Secretary of Education, has now been signed by nearly 2,800 Calvin Knights. What prompted you to write the letter, and did you have any idea that it would provoke this kind of response?

Sara Moslener: Like a lot of people I’ve been feeling an urgency about becoming more directly involved in politics. To me that meant sending a letter to my two Senators here in Michigan about Betsy DeVos and her lack of concern with federal regulations, something she’s demonstrated in her previous work and at her confirmation hearing. Without those federal regulations, there’s no assurance that students with different kinds of learning needs will be served, which ends up reinforcing a social hierarchy. After I wrote the letter, I thought that maybe some other Calvin College graduates might like to sign it, and that if I could get 30, 40 or even 50 people to sign, well, that would really say something. By Monday night there were almost 1,000 signatures. Then the Calvin College newspaper got a hold of it and current students started signing on.

EduShyster: Calvin alumni from as far back as 1947 have signed on, but it’s the opposition to DeVos among younger alumni and students who are attending Calvin now that’s so striking. As an historian of evangelicalism are you surprised by this?

Moslener: When you look at the letter, once you get past 2005, the lists of students from each successive year just get longer and longer. It doesn’t surprise me at all, by the way, that students are engaged. What I know about young evangelicals is that they are much more politically progressive than older evangelicals. This is also true of students at Calvin, which is in the Christian Reform tradition and on the cusp of evangelicalism. Many millennial evangelicals supported Obama, and they care deeply about climate change. Now the narrative is that 85% of white evangelicals voted for Trump, so I think this is interesting in light of that.

EduShyster: During my recent trip to Grand Rapids, I dropped by a fave DeVos organization: the Acton Institute, which seeks to integrate Judeo-Christian truths with free market principles. And during her confirmation hearing, Betsy DeVos gave a That Old School Spirit – EduShyster:

Devos is the latest in Trump’s series of “Corporate Cabinet” nominees with vast personal wealth or deep ties to Wall Street and is widely considered to be Trump’s most vulnerable nominee.
Chicago area students and allies are also demanding Gov. Bruce Rauner and Speaker Michael Madigan resist Trump’s agenda by fully funding public education from pre-K through college by closing corporate tax loopholes, passing the LaSalle Street Tax, and requiring wealthy people like Gov. Rauner to pay their fair share of income taxes. Rauner and Madigan must also make free and fully funded public higher education accessible to ALL Illinois students, including undocumented students, by passing the Student ACCESS Bill (SB 2196).

We should care who sits on the U.S. Supreme Court because court decisions affect our collective bargaining rights, the access our students have to the educational opportunities they deserve, and our children’s (and grandchildren’s) future. Justices may hold their appointments for life; that gives them ample time to impact the rights we hold dear—for better or worse.

Here are a few meaningful rulings for education and educators—from the recent decision reaffirming collective bargaining rights for public employees, to the 63-year-old decision ruling that “separate but equal” schools were unconstitutional. We’ve also included pending cases that will have far-reaching impacts when decisions are handed down.

Trinity Lutheran Church of Columbia, Inc. v. Pauley (pending 2017)

Missouri’s state constitution, like those in many states, forbids any state financial aid from going—directly or indirectly—to a religious institution. The Supreme Court will decide whether state bans on contributions to religious institutions, like Missouri’s, violate the Constitution’s Equal Protection Clause or the religious clauses of the First Amendment. A decision striking down Missouri’s constitutional provision could result in states being required to fund religious schools along with public schools.

Gloucester County School Board v. G.G. (pending 2017)

G.G. is a transgender student who uses the boys’ bathroom at his Virginia high school without incident. But spurred on by community disdain for G.G, the school board adopted a policy requiring students to use only the bathroom associated with their gender assigned at birth. The Supreme Court will decide whether transgender students have a right under federal law to be treated consistent with their gender identity.

Friedrichs v. California Teachers Association (2016)

Both public employees and public employers have a compelling interest in having strong and effective collective bargaining. The 4-4 ruling left intact the precedent established by Abood v. Detroit Board of Education, the 1977 case in which the court upheld the fair share fees that support collective bargaining.

Fisher v. University of Texas at Austin (2016)

Abigail Fisher applied and was denied admission to the University of Texas, and sued, saying the university had practiced racial discrimination. The court upheld the university’s race-conscious admissions program, which aims to matriculate a “critical mass” of minority students so that all may reap the benefits of a diverse student body, ruling that it is lawful under the Equal Protection Clause of the Fourteenth Amendment.

Parents Involved in Community Schools v. Seattle School District No. 1 (2007)

Recognizing that their schools were highly segregated by race, Seattle assigned students to certain schools, using race as one factor in the decision, which resulted in less segregation and a narrower achievement gap. The Supreme Court held that public schools were prohibited from considering race as a factor in assignments, even if the school district wished to make up for past discrimination against people of color, because such consideration was a violation of the Equal Protection Clause.

Grutter v. Bollinger (2003)

Barbara Grutter alleged that her Equal Protection rights were violated by the University of Michigan Law School’s attempt to gain a diverse student body that resulted in the denial of her application for admission. The Supreme Court disagreed and held that institutions of higher education have a legitimate interest in promoting diversity.

Zelman v. Simmons-Harris (2002)

Betsy DeVos, the Michigan billionaire President Trump tapped as his education secretary, delivered answers Monday to the more than 1,000 questions put to her by Democrats on the Senate education committee, just one day before the panel is set to vote on her confirmation. The Democrats said they were not satisfied with her responses on critical questions.

The Senate Committee on Health, Education, Labor and Pensions is set to vote on her confirmation at 10 a.m. Jan. 31, a week later than it was originally scheduled. On Monday, Sen. Patty Murray (D-Wash.), the ranking member of the committee, urged the chairman, Republican Sen. Lamar Alexander of Tennessee, to delay the vote again, but Alexander declined.

The DeVos nomination has become as controversial as any of Trump’s Cabinet picks. Her supporters see her as a champion of school choice. Critics say her advocacy in education proves she wants to privatize public education.

The pitched battle over her nomination intensified over the weekend and Monday. Supporters began running paid advertisements on the Internet urging the Senate to confirm her, while critics rallied on Capitol Hill to oppose her and more calls against her surfaced. More than 1,400 members of the community at the elite Williams College released a letter objecting to her confirmation, saying that her refusal to “support federal policies regarding educational systems that receive public funding” was disqualifying.

During her Jan. 17 confirmation hearing before Alexander’s committee, she failed to show an understanding of some key education issues, and Democrats later submitted questions to her to answer before the vote. Alexander moved the committee vote from Jan. 24 to Jan. 31 to give her time to answer the questions.

Democrats asked her, according to Alexander, 837 follow-up questions, some of them with several parts, amounting to a total of 1,397 questions. DeVos delivered the answers at about 10:30 a.m. Monday, about 24 hours before the vote. Democrats on the committee were not impressed.

Murray’s office released this statement:

“After an initial review of the responses sent to Committee members with less than twenty four hours before the scheduled vote, staff has identified a number of critical questions about Ms. DeVos’ financial disclosure to the Committee and other areas that have not been answered to anywhere close to satisfaction. Senator Murray does not believe that members of the Committee have enough information about Ms. DeVos’ opaque finances, conflicts of interest, and other Democrats: DeVos didn’t provide ‘anywhere close to satisfaction’ on our questions - The Washington Post:

Here are 139 questions — some of them with a number of parts — that Sen. Patty Murray (Wash.), the highest-ranking Democrat on the Senate Education Committee, asked Betsy DeVos, the Michigan billionaire nominated by President Trump to be U.S. education secretary.

On Monday morning, DeVos delivered answers to more than 800 questions to Democrats on the committee who had posed queries to her after her performance at the Jan. 17 confirmation hearing, at which she displayed little knowledge of key education issues.
