I’ve had a little time to reflect on my night over as Chicago Math and Science Academy, the northside charter that’s attempting to persuade the NLRB that it’s a private employer and therefore not subject to the public sector collective bargaining laws. There’s a lot at stake, including the issue of card check vs. secret ballot, as well as the whole host of good faith responsibilities the school would have to carry out as a public sector employer under state law. If you take a gander at what’s happened to labor in the private sector, you start to get the idea.


In a sense, it’s an age-old story: employer stiff-arming employees as they unionize, using every tactic at their disposal. In this case, the board has played hardball all along, even firing one of the (then pregnant) early organizers. Now they’re using the provocative “we’re private” argument to circumvent state law, which i
