Lots of State Legislatures Are Launching New or Expanding Older School Voucher Programs

There is sadly no mystery about the damage befalling public schools when private school tuition vouchers are expanded: Vouchers suck millions of essential dollars out of state and local public school budgets. Usually state legislatures start with a small program and then, several years later, explode the number of students eligible and the size of each voucher. Even though we know that aggregate standardized test scores reflect primarily a school district’s economic level and are a flawed measure of school quality, voucher proponents regularly market their new product as an escape for the poorest children from so-called “failing” schools.

Vouchers originally started in two of the nation’s school districts that serve concentrations of poor children: Milwaukee and Cleveland. But in 2021, we are watching a new phase of nationwide growth and expansion of vouchers.

In 2017, economist Gordon Lafer explained: “From 2011 to 2015, eighteen states established some form of voucher program. Vouchers are typically introduced as a limited, targeted intervention aimed at helping the neediest families but then expanded gradually to cover the general population. The country’s oldest voucher program was established in Milwaukee in 1990 and was restricted to poor children in failing schools and capped at a limited number of participants. In 2011, Governor Walker removed the cap, raised the income eligibility threshold, and expanded the program to include students in suburban counties. In 2013 the program was expanded yet again, this time to cover the entire state. $1 billion per year has produced few -- if any -- products worth buying in Florida's voucher marketplace. That's because markets alone don't create capacity; and there is no equity without capacity.

Put aside what you think about Jeff Bezos and Amazon as person and company. This article isn’t about either; it’s about school vouchers. But I saw Bezos use a thought-provoking phrase in his annual stockholder letter. I find it quite helpful in assessing the catastrophic human and economic failures of Florida’s school voucher programs.

“If you want to be successful in business (in life, actually), you have to create more than you consume. Your goal should be to create value for everyone you interact with.” 

Again, put aside whether you think Bezos or Amazon do that. Put aside how easily that statement can lead you to eugenics if you follow its logic into human existence. Put aside the fuzzy definitions of creation and consumption. Let’s just take it on business/economics/marketplace terms.

Doug Tuthill’s schools and organization consume *infinitely* more than they create — here’s a documentary

No institution of any kind in America consumes more money and creates less value than Florida’s voucher school provider network. None. Florida’s failed voucher schools have the worst consumption-to-creation ratio of any large-scale business or private function I have ever seen. Step up for Students, as an organization, consumes so much more than it creates that it’s virtually impossible to quantify the disproportion. Here’s a taste, from an organization that provides zero active quality oversight of its schools or marketplace.

For a quarter of a century, Ohio has pursued the accountability-based “education reform” strategy that was formalized in the 2002 No Child Left Behind Act.

Ohio holds schools accountable for raising students’ scores on high-stakes standardized tests by imposing sanctions on schools and school districts unable quickly to raise scores. Ohio identifies so-called “failing” public schools, ranks them on school district report cards, and locates privatized charter schools and voucher qualification within the boundaries of low-scoring districts.  Additionally, the state takes over so-called failing school districts and imposes Academic Distress Commissions as overseers. Ohio’s students are held back in third grade if their reading scores are too low, and high school seniors must pass exit exams to graduate.

After more than two decades of this sort of school policy, student achievement hasn’t increased and test score gaps have not closed.  Ohio is a state with eight big cities—Cleveland, Columbus, Dayton, Cincinnati, Toledo, Youngstown, Akron, and Canton; lots of smaller cities and towns; Appalachian rural areas and Indiana-like rural areas; and myriad income-stratified suburbs. Just as they do across the United States, aggregate standardized test scores correlate most closely with family and neighborhood income, not with the characteristics of the public schools. In the fall of 2019, the Plain Dealer’s data wonk, Rich Exner, created a series of bar graphs to demonstrate the almost perfect correlation of school districts’ letter grades on the state school district report card with family income.

But while Ohio has punished so-called “failing” schools, it hasn’t done much to help the public schools in Ohio’s poorest communities. A "Sparrow Academy" experience demonstrates why the Step Up for Students voucher school "marketplace" needs a grand jury, a Grady Judd task force, and fundamental reform -- not an expansion.

I’ll be referring to the mother in this article by her initials, CS. And I’m using the pseudonym “Terry” for her son.

On April 1, CS received a strange note about her son’s “McKay” special needs voucher from the school secretary of Lakeland’s Sparrow Academy. Sparrow is a voucher school with 100 percent special needs/ESE enrollment that Terry had formerly attended. You can see some of Sparrow’s marketing content above.

Good morning, I was about to put [Terry’s] packet in the mail when the scholarship checks arrived. If it would be OK when you come to sign the check can I give you his packet?  There isn't school tomorrow, Good Friday.

Sparrow principal Vance Linholm had kicked Terry out of school via text on March 16, two weeks before that email. I’ll show you that text in a second. Since that day, CS had been struggling to get any documentation of Terry’s performance and discipline record for his 18 months or so with the school. She had been going back and forth with the secretary. Now, the school was saying it would give her a packet of his work “when you come to sign the check” — weeks after the school had dismissed Terry.

West Virginia Passes Sweeping Voucher Bill

Republicans in West Virginia passed a dramatic voucher bill that allows people to spend public education funds on almost anything. Governor Jim Justice, a billionaire, signed the bill into law.

West Virginia Gov. Jim Justice on Saturday signed into law the bill that school-choice advocates say will implement the nation’s broadest nonpublic school vouchers program.

Programs in other states are limited to low-income, special-needs or other subsets of students, or have caps on the number of recipients in general. But West Virginia’s program will be open to all K-12 students, including by offering public money to families who already don’t use the public school system.

Effective beginning in the 2022-23 school year, families who withdraw their children from public schools can receive a currently estimated $4,600 per-student, per-year for private- and home-schooling expenses. Parents Defending Education has just popped onto the education policy landscape, and they have staked out their spot in the new battle to inculcate children with the Proper American Values.

They would like to sell themselves as a grassroots organization; there is no particular reason to believe that's true, and I'm going to refer you to this post from the indispensable Mercedes Schneider to see exactly how this group is the product of professional astro-turfers. So take a moment and go read her post before you finish this one. Go ahead--I'll wait.

So Dr. Schneider has laid out who these people are. I want to follow that up with a look at what they're up to.

Vouchers Are About Abandoning Public Education, Not Freeing Parents

As the GOP mounts a multi-state initiative to implement vouchers or super-voucher education savings accounts in many states across the country, it's becoming increasingly clear that we've been looking at the voucher movement through the wrong lens (which is to day, the lens that voucheristas have promoted). 

Vouchers are not about freeing or empowering parents. They are about empowering private interests to chomp away at the giant mountain of education money in this country. They are about dismantling any sort of oversight and accountability; it's striking how many of these voucher bills/laws very specifically forbid the state to interfere with the vendors in any way, shape or form. 

Think of voucher programs this way.

The state announces, "We are dismantling the public education system. You are on your own. You will have to shop for your child's education, piece by piece, in a marketplace bound by very little oversight and very few guardrails. In this new education ecosystem, you will have to pay your own way. To take some of the sting out of this, we'll give you a small pocketful of money to help defray expenses. Good luck."

It's not a voucher system. It's a pay your own way system. It's a you're on your own system. The voucher is not the point of the system; it's simply a small payment to keep you from noticing that you've just been cut loose.

There was much hope here in Mudville about a trigger of militancy in NYC -  but I pointed out teachers in West Virginia were eating pet food - don't forget  - it's the economy, stupid, not the ideology.

One of my fave warriors against ed deform, Jennifer Berkshire with her writing

partner Jack Schneider, authors of Wolf at the Schoolhouse Door were interviewed today with one of my fave podcasters, Sam Seder, on Majority Report - listen to the wide ranging discussion of how ed deform got into the door and where it intends to take us to the end of public ed  - (https://youtu.be/ZX05_S17u9M). But let me focus on just one aspect of the interview.

Jennifer (also check out their podcast - Have you Heard) pointed out that West Virginia legislature passed the most oppressive voucher law you can imagine which fundamentally can kill the entire WV public school system and turn the state into what happened in New Orleans. I've been worried since the pandemic began that this will be an opportunity to tie a noose around public school systems - and watch all the people who are screaming about how important it is for kids to be in school jump ship to virtual learning when it becomes convenient. Jennifer pointed out how fundamentally this is all about saving money and since labor is the major cost of education, de-unionizing and de-skilling teachers is the goal. Since teacher unions are one of the major bulwarks of the Dem Party, I see the threat of killing our unions as greater than the voter suppression movements by Republicans.

GA: To Get A Voucher, Give Up Rights

Georgia is on the voucher expansion bus that so many GOP-run states are vacationing on this year, but their vouchers (like those in some other states) have a special wrinkle--a requirement for students with special needs to give up their rights if they want a voucher.

Senate Bill 47 has a variety of the usual features, including a huge expansion of voucher eligibility (because, as many states are poised to re-demonstrate, the voucher playbook is to get a foot in the door by starting the program for the neediest students, and then expand expand expand). But it includes this fun paragraph: 

With respect to local school systems, the acceptance Acceptance of a scholarship shall have the same effect as a parental refusal to consent to services pursuant to the Individuals with Disabilities Education Act, 20 U.S.C.A. Section 1400, et seq., and a parental waiver of rights to educational accommodations under Section 504 of the federal Rehabilitation Act of 1973, 29 U.S.C.A. Section 701, et seq.

There's a bit of a one-two punch here, because SB47 also adds some language about funding-- whereas the old language said that the student should be followed by "an amount equivalent to the costs of the educational program that would have been provided for the student in the resident school system," the added language specifies that if the child had an Individualized Education Program (IEP), then the amount that follows them should factor in the cost of following that IEP.

Florida: League of Women Voters Exposes Voucher Boondoggle As Big Business

The Florida League of Women Voters has long been wary about the state’s rush to privatize public school funding through charters and vouchers. It has previously published reports on the conflicts of interests, the politics, and the money in the charter sector. In this report, it investigates the organization created to hand out money for vouchers, called “Step Up for Students.” I am posting only the introduction. For the past 20 years, a private organization has been growing exponentially using direct and indirect public funds largely out of public view. This organization is the conduit for an unregulated school system without standards being created by the Florida Legislature.

The organization is called Step Up for Students (StepUpForStudents.org), an SFO (Scholarship Funding Organization) that awards and manages tax credit scholarships for the state of Florida, as well as in Alabama.  According to Forbes, Step Up is the 21^st largest charity in the United States. To put that in perspective, the American Cancer Society is 18^th. In 2019 Step Up and Subsidiaries had $697,363,075 in total assets. 

Step Up began with a mission to award vouchers to low-income students to attend private schools. It has grown to include vouchers, now known as scholarships, for students with special needs, students who have been bullied, students who are homeschooled, and students with reading difficulties. The income threshold has been raised through the years to at least 300% of the poverty level, with no income threshold for homeschool or special needs students.

ND: Kneecapping Public Education

North Dakota's governor just signed SB 2196 into law, allowing the state to quietly slip forward in 2021's race to dismantle public education. While other state legislatures have focused on vouchers, North Dakota took its leap forward by focusing on unbundling and competency based education.

SB 2196 is short and the changes it enacts even shorter. It amends the rules about instructional time requirements with this sentence:

Establish and certify a North Dakota competency framework to allow students who have demonstrated content mastery of units required under sections 15.1-21-01 and 15.1-21-02 to waive unit instructional time requirements under section 15.1-21-03.

In headline-ready English, that means the bill will "expand learning outside classroom." Or as state K-12 Superintendent Kirsten Baesler puts it, "A student’s ability to learn is not completely dependent upon how much time he or she spends sitting in a classroom." Baesler was a school librarian, a principal, and a school board member. In office since 2013, she was a proponent of Common Core (she also has two arrests--one for domestic violence and another for DUI).

The bill now allows students to accumulate school credit for "community volunteer projects, internships, and other educational options." Baesler has thrown some other language at it, touting "personalization" and "methods of learning." Florida Voucher School Hires Unqualified Teachers, Ex-Con, State Doesn’t Care

The Orlando Sentinel has been covering scandal after scandal in the voucher schools of Florida, but the Legislature doesn’t care about their scandals and is planning to take even more money from public schools to fund more private voucher schools. The Sentinel published a story about one troubled voucher school that has received over $5 million from the state since 2015 despite the fact that it hires teachers without college degrees.

Leslie Postal and Annie Martin wrote about Winners Primary School in Orange County, which recently changed its name to Providence Christian Preparatory School:

The job applicant hoped to teach fourth grade at Winners Primary School, a small private school in west Orange County. She didn’t have a college degree and her last job was at a child care center, which fired her.

Power used the Tampa Bay Times' Pulitzer tagline to strip mine Florida's public schools. It largely ignored the Orlando Sentinel's better, further-reaching voucher reporting. Why?

Today’s Part 4 is a comprehensive history and accounting of the consequences from Florida’s two most important pieces of newspaper journalism since 2015. Both concern education; and both illustrate how power determines the impact of journalism, in different ways. This article may be truncated in email delivery; so you should plan to click through to the website.

It would take a reporter at the Tampa Bay Times, to which I am a subscriber, a couple of days at most to go through the Step Up for Students website and compile a spreadsheet of voucher schools for the counties in their coverage area — with the same information I put together in this spreadsheet. (I will send you the full sheet if you want it, TBT, for a template.)

I would bet my house that every county would have a giant list of racially and ESE-segregated voucher schools with no accreditation or oversight or capital. These voucher schools exist only because of direct taxpayer funding or because big corporations get a public dollar-for-dollar tax break for funding them directly rather than funding real public schools.

In Polk County, 16 voucher schools have enrollments that are at least 76 percent black. Twelve of the 16 schools are at least 95 percent black or greater. Six are 100 percent black. Not one of those schools has accreditation, of any kind. More than 800 black children attend these segregated, no-capital “schools.”

Max Brantley writes in the Arkansas Times that the voucher lobby is determined to reverse their 44-52 loss in the Arkansas House. Backed by Walton money, they are naming and shaming the legislators who stood up for their community’s public schools.

Although Sam Walton, founder of Walmart, and his children attended public schools, they are determined to destroy public schools that provide the same opportunity for other people’s children. They blithely toss out millions to buy the support of people who have no heart or soul and will gladly lobby to harm the institution that has been an abiding symbol of our democracy for generations. Public schools have failings, like every other institution. They must be far better, and they should have the respect and the funding to provide equal opportunity to all children.

But the Waltons have led the forces of greed that seek to undermine public schools that accept all students and have standards for professionals. The smartest way to shop for a voucher school is not to shop for one at all. There are very very few worth buying. This is why the education savings account (ESA) concept is doomed as anything but grift.

When Kelli Stargel dismantles your educational Publix this legislative session and gives you a dollar store debit card for educational groceries instead, it doesn’t mean the dollar store gets anything better on its shelves. The dollar store doesn’t have the capital or product development systems that Publix has built over decades. The dollar store doesn’t have supermarket capacity.

There is almost nothing worth buying today in the ESA dollar store; and there will be almost nothing worth buying in the future.
